Who should use this Commission Agreement?

Where one person introduces a potential customer to another person who will be delivering goods or services in exchange for the lead or introductory commission, then this Lead Commission Agreement can be used to record the agreement between the parties. Note that this Commission Agreement is intended for use for a specific, once-off lead or referral, as opposed to recurring commissions earned for future, as yet undetermined leads. What does the Commission Agreement say?

The Agreement:

Generally defines the roles of both the person identifying or sourcing the customer, and the person delivering the goods or services
Provides for protection of confidential information
Sets out the rights of termination of the contract
Sets out the commission calculation in the event of the referral resulting in either a once-off sale, or a recurring (for example monthly / retainer) sale.
Provides for dispute resolution

Briefly state the nature of goods or services offered by Supplier in clause 2.1
Describe the opportunity / client in clause 2.2
Complete both parties’ details (names and addresses) in clause 1, with the person supplying the goods or services as the Supplier, and the person introducing the customer as the Associate
Complete the commission structure in clauses 6 and/or 7, as applicable.
Get both parties to sign the document.
